Environmental Protection Administration (EPA) has, in accordance with amendments to Article 74 of “Toxic and Concerned Chemical Substances Control Act” (hereinafter referred to as the Act) enacted on January 16, 2019, amended the “Toxic and Concerned Chemical Substances Control Act Enforcement Rules” (hereinafter referred to as the Enforcement Rules).
Apart from including concerned chemical substances in relevant regulations, EPA has further specified “mail orders and online shopping”, which are newly added to the Act; stipulates the key criteria and content for competent authorities to take disposal measures; and adopted apractice-based methods in the Enforcement Rules.
Toxic and Chemical Substances Bureau, Environmental Protection Administration, Executive Yuan expressed that the Enforcement Rules aimed to specify details and technical matters related to the Act, whereas regulations related to newly added items of the Act, such as the list of concerned chemical substances, emergency responders and the fund, would be further specified in subordinate regulations. As for related subordinate regulations, the drafts thereof will be preliminarily announced in succession.
